AGREEMENT TO TERMS

In the event of any errors or mistakes in pricing, we reserve the right to correct them, even if payment has been requested or received. Moreover, we maintain the discretion to decline any order placed through the Site.


CANCELLATION

Please note that all purchases made are non-refundable. If you wish to cancel your subscription, you have the freedom to do so at any time by logging into your account. Upon cancellation, your subscription will remain active until the end of the current paid term.


PROHIBITED ACTIVITIES

Your use of the Site must align with its intended purpose, and you are strictly prohibited from using it for any other purposes. The Site is not to be utilized for commercial endeavors unless explicitly endorsed or approved by us.

As a user of the Site, you agree to refrain from engaging in the following activities:

  1. Systematically retrieving data or content from the Site to create collections, compilations, databases, or directories without obtaining our written permission.

  2. Making unauthorized use of the Site, including collecting usernames or email addresses for sending unsolicited emails, or creating user accounts through automated means or false pretenses.

  17. Using the Site in violation of applicable laws or regulations.

USER GENERATED CONTRIBUTIONS

The Site does not currently offer users the ability to submit or post content. However, there may be instances where we provide you with opportunities to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials on the Site, collectively referred to as “Contributions.” These Contributions could include text, writings, videos, audios, photographs, graphics, comments, suggestions, personal information, or other materials. Please be aware that any Contributions you transmit may be viewable by other Site users and through third-party websites. Consequently, the treatment of your Contributions will be governed by the Site’s Privacy Policy.

By creating or making available any Contributions, you represent and warrant that:

  1. Your Contributions do not infringe upon the proprietary rights of any third party, including but not limited to copyright, patent, trademark, trade secret, or moral rights.

  2. You are the rightful creator and owner of the Contributions or possess the necessary licenses, rights, consents, releases, and permissions to authorize us, the Site, and other users of the Site to use your Contributions as contemplated by these Terms of Use.

  3. You have obtained written consent, releases, and/or permissions from all identifiable individuals featured in your Contributions to enable their inclusion and use in accordance with these Terms of Use.

  4. Your Contributions are accurate, truthful, and not misleading.

  5. Your Contributions do not involve unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or any form of solicitation.

  6. Your Contributions are not obscene, lewd, lascivious, violent, harassing, libelous, slanderous, or otherwise objectionable, as determined by us.

  7. Your Contributions do not ridicule, mock, disparage, intimidate, or abuse any individual or group.

  8. Your Contributions do not advocate for the violent overthrow of any government or incite, encourage, or threaten physical harm against others.

  9. Your Contributions comply with all applicable laws, regulations, and rules.

  10. Your Contributions do not violate the privacy or publicity rights of any third party.

  11. Your Contributions do not solicit personal information from individuals under the age of 18 or exploit minors in a sexual or violent manner.

  12. Your Contributions do not involve any material related to child pornography or that may jeopardize the health or well-being of minors.

  13. Your Contributions do not include offensive comments related to race, national origin, gender, sexual preference, or physical handicap.

  14. Your Contributions do not violate any provision of these Terms of Use or any applicable law or regulation, including linking to material that breaches these terms.

Engaging in any activity that violates the above requirements constitutes a breach of these Terms of Use and may result in the termination or suspension of your rights to use the Site.


CONTRIBUTION LICENSE

Both you and the Site acknowledge and consent that we may access, store, process, and utilize any information and personal data you provide, adhering to the terms outlined in the Privacy Policy and your chosen preferences (including settings).

If you submit suggestions or other feedback concerning the Site, you agree that we have the right to use and share such feedback for any purpose without compensating you.

We do not claim ownership over your Contributions. You retain complete ownership of all your Contributions, including any associated intellectual property rights or other proprietary rights. We shall not be held liable for any statements or representations present in your Contributions submitted on any section of the Site. You bear sole responsibility for your Contributions to the Site, and you explicitly agree to release us from any and all liability and to refrain from taking any legal action against us related to your Contributions.


SUBMISSIONS

You acknowledge and consent that any questions, comments, suggestions, ideas, feedback, or other information regarding the Site (“Submissions”) provided by you to us are not considered confidential and will become our exclusive property. We shall possess full rights, including all intellectual property rights, and have the unrestricted privilege to use and distribute these Submissions for any lawful purpose, be it commercial or otherwise, without acknowledging or compensating you. By providing Submissions, you hereby waive any moral rights associated with them, and you also affirm that these Submissions are either original creations by you or that you have the right to submit them. Furthermore, you agree that there will be no recourse against us for any alleged or actual infringement or misappropriation of any proprietary right present in your Submissions.

  5. Manage the Site in a manner aimed at safeguarding our rights and property and ensuring the proper functioning of the Site.

In addition to account termination or suspension, we reserve the right to pursue appropriate legal action, including, but not limited to, seeking civil, criminal, and injunctive remedies.

DISPUTE RESOLUTION

Informal Negotiations

In an effort to achieve prompt resolution and manage the expenses associated with any dispute, controversy, or claim arising from these Terms of Use (referred to as a “Dispute” and collectively as “Disputes”), both you and us (individually, a “Party,” and collectively, the “Parties”) agree to initially engage in informal negotiations for at least thirty (30) days before resorting to arbitration. This informal negotiation process begins upon one Party providing written notice to the other Party. Please note that this informal negotiation requirement does not apply to specific Disputes expressly stated below.


CORRECTIONS

The Site may contain information with typographical errors, inaccuracies, or omissions, including descriptions, pricing, and availability, among other details. We retain the right to rectify any such errors, inaccuracies, or omissions and to modify or update the information on the Site without any prior notice.


DISCLAIMER

11. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?
